Arbitration Agreement
Last updated October 14, 2026
Please read carefully. This agreement affects your legal rights. It requires most disputes to be resolved by binding individual arbitration instead of in court, and it waives jury trials and class actions. You may opt out within 30 days (section 8).
1. Scope
This Arbitration Agreement applies to any dispute, claim or controversy between you and Harden Construction Group Inc. (“Harden Construction Group,” “we,” “us”) arising out of or relating to this website, our Terms & Conditions, our Privacy Policy, or communications you receive from us through the website (including calls and texts), whether based on contract, statute, tort or any other legal theory (a “Dispute”).
Construction contracts. If you sign a written construction contract with us, the dispute-resolution terms of that contract govern disputes about the work. This agreement applies only to the extent the contract does not address them.
2. Informal resolution first
Before starting arbitration, you agree to contact us and try to resolve the Dispute informally. Send a written notice describing the Dispute and the relief you want to [email protected]. We’ll do the same if we have a Dispute with you. If it isn’t resolved within 30 days after the notice is received, either party may begin arbitration.
3. Binding arbitration
Any Dispute not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules: the Consumer Arbitration Rules for consumer Disputes, or the Construction Industry Arbitration Rules where the Dispute concerns construction services. The Federal Arbitration Act and, where applicable, the North Carolina Revised Uniform Arbitration Act govern this agreement. A single neutral arbitrator will decide the Dispute and may award the same individual relief a court could award.
4. Location & costs
Arbitration will take place in Brunswick County, North Carolina, or by phone or video if both parties agree. Filing and arbitrator fees are paid as provided by the AAA rules. For consumer Disputes, we will pay any amount required by those rules so that your costs don’t exceed what you would pay to file in court.
5. Exceptions
- Either party may bring an individual claim in small claims court if it qualifies.
- Either party may seek emergency injunctive relief in court to prevent irreparable harm while arbitration is pending.
- Claims to protect intellectual property may be brought in court.
6. Class action & jury waiver
You and Harden Construction Group agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims of more than one person. You and we each waive the right to a trial by jury.
7. Severability
If the class action waiver in section 6 is found unenforceable for any Dispute, that Dispute will proceed in court, not arbitration. If any other part of this agreement is found unenforceable, the rest remains in effect.
8. Your right to opt out
You may opt out of this Arbitration Agreement within 30 days of first using this website or first submitting our contact form. Email [email protected] with your name, phone number and a clear statement that you opt out of arbitration. Opting out doesn’t affect any other part of the Terms.
9. Changes
If we change this agreement, the change won’t apply to a Dispute we already had notice of before the change.
